Content Creator Terms

1. Agreement and Eligibility

These Content Creator Terms (the “Creator Terms”) apply when you apply for, receive or use a creator profile, creator league, referral link, promotional material or creator dashboard on the AI Premier League Predictor platform (the “Platform”). By accepting these Creator Terms, you enter into an agreement with Big Noise Media Ltd (company number 13506460), a private limited company registered in England and Wales, whose registered office is at 4 Studio Court, Queensway, Bletchley, Milton Keynes, England, MK2 2DG, as the Platform operator.

You must be at least 18 years old and legally able to enter into this agreement. If you apply for a company or organisation, you confirm that you have authority to bind it. Approval is discretionary and is not guaranteed.

2. Independent Creator Relationship

You act as an independent content creator. Nothing in these Creator Terms creates employment, agency, partnership, joint venture or authority for you to bind the Platform operator.

Unless the Platform operator expressly approves a statement in writing, you must not claim to speak for, represent or make commitments on behalf of the Platform.

3. Your Views, Opinions and Content

All views, opinions, predictions, statements and other content you publish are your own. They do not necessarily reflect, and must not be presented as, the views or opinions of the Platform operator.

You are responsible for the content you create, upload, submit or publish, including its accuracy, legality and effect on others. To the fullest extent permitted by law, the Platform operator is not responsible for a creator’s personal views, opinions or independently published content. Nothing in these Creator Terms excludes any responsibility that cannot lawfully be excluded.

4. Creator Content and Rights

You retain ownership of content that you own. You must have all permissions, licences and releases needed for anything you submit to the Platform, including text, photographs, video, audio, music, logos, trademarks and material featuring another person.

When you submit content to the Platform, you grant the Platform operator a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, distribute and use that content only to operate, secure, improve and promote the Platform, your creator league and related campaigns. This licence may be sublicensed to service providers working for those purposes and continues for a reasonable period after removal where required for backups, legal compliance or material already used in a published campaign.

5. Acceptable Content and Conduct

You must comply with applicable law, these Creator Terms, the Platform rules and the rules of any third-party service you use, including YouTube, Google, TikTok, Instagram and X. You must not submit or promote content that:

• •Is unlawful, fraudulent, defamatory, threatening, hateful, discriminatory, harassing, sexually exploitative or seriously harmful
• •Infringes copyright, trademark, privacy, publicity or other rights
• •Contains malware, phishing, spam, deceptive links or attempts to obtain unauthorised access
• •Impersonates another person or misrepresents your identity, audience, engagement or relationship with the Platform
• •Manipulates followers, views, referrals, entries, predictions, scores, payments or other platform measurements
• •Encourages unlawful gambling, presents the Platform as betting, or makes unauthorised claims about odds or guaranteed winnings
• •Publishes confidential information, personal data or private communications without lawful authority

6. Advertising and Affiliate Disclosure

A post containing your referral link or code, or a post for which you may receive commission, rewards, free access or another benefit, may be advertising. You must ensure that every such communication is obviously identifiable as advertising before a person engages with it.

Use a clear, prominent and upfront label such as “Ad” where required. Do not rely only on ambiguous labels such as “affiliate”, “aff” or a disclosure hidden after “see more”. You must comply with the CAP Code, ASA guidance, applicable consumer-protection law and the advertising tools and policies of each social platform.

You must make only accurate, current and supportable claims. You must use the official competition, pricing, prize and eligibility wording supplied by the Platform and must not invent prizes, deadlines, benefits, endorsements or guarantees. The Platform may require correction or removal of non-compliant promotions.

7. Brand, Clubs and Third-Party Platforms

The Platform is independent and is not affiliated with, endorsed by or sponsored by the Premier League, Sky Sports, any football club, UEFA, The FA, EFL or any competition organiser unless expressly stated in writing.

You may use Platform-approved creator assets in accordance with supplied brand guidelines. You must not use club badges, league logos, player images, music, footage or other protected material unless you have the necessary rights. Your use of YouTube, Google and other third-party services remains governed by their own terms and policies; the Platform does not control those services.

8. Creator League and Community Duties

An approved creator receives a creator profile and league managed through the creator dashboard. You must use moderation tools responsibly, treat members fairly and promptly report credible safety, fraud or legal concerns.

You must not sell league access, collect member payments outside approved Platform systems, promise preferential scoring, or suggest that spending improves prediction results. Platform competition rules, scoring, eligibility and final administrative decisions apply to every creator league.

9. Referrals, Commission, Payouts and Tax

No commission is earned merely by applying, being approved, gaining followers or displaying an estimate. Commission is payable only where a separate commission schedule or written commercial offer is active and the Platform records eligible, settled revenue attributable to your approved referral link or code.

Where commission is earned, earnings are held for 28 days from the date they are recorded as eligible and settled. Eligible payouts are processed on the 28th day of each month after the hold period ends. Payment timing, rates, thresholds and eligible products are shown in the applicable commission schedule.

Any dashboard figure marked estimated, pending or projected is not an amount due. Big Noise Media Ltd may withhold, reverse or adjust earnings for refunds, chargebacks, fraud, duplicate accounts, breaches of these Creator Terms or competition abuse, and for processing fees and ineligible or duplicate transactions.

You are responsible for your own tax registration, declarations and liabilities, and for ensuring your content and activity comply with applicable law. We may request identity, address, bank, tax or eligibility information before payment and may withhold payment where reasonably required for verification, fraud review or legal compliance.

10. Accounts, Security and Data

You must provide accurate information, keep your login secure and notify us promptly of suspected unauthorised access. You may not transfer or sell your creator account, league, referral link or dashboard access.

Personal data must be handled only through approved Platform tools and for the purpose for which access is provided. You must not scrape, export, sell, disclose or use member information for unrelated marketing. Our Privacy Policy explains how the Platform processes personal data.

11. Monitoring, Removal and Suspension

The Platform may review creator profiles, league activity, referral activity and content submitted to the Platform to protect users, investigate complaints, prevent fraud and enforce these Creator Terms.

We may restrict, remove or require changes to content, suspend creator tools, withhold disputed amounts or terminate creator status where we reasonably believe there is a material or repeated breach, illegal activity, fraud, security risk or likely harm to users, third parties or the Platform. Where reasonably possible, we will explain the action and allow you to respond, unless doing so could cause harm, breach the law or compromise an investigation or platform security.

12. Ending the Creator Relationship

You may stop participating by contacting support. The Platform may end the creator relationship on reasonable notice or immediately for a serious breach, fraud, illegality, safety risk or conduct likely to create material harm or liability.

On termination, creator dashboard access and use of Platform branding must stop. Valid, undisputed commission earned under an active commission schedule before termination remains subject to verification, adjustments and the payment terms of that schedule. Provisions intended to survive termination, including ownership, licences already relied upon, confidentiality, liability and dispute provisions, will continue.

13. Platform Availability and Liability

The Platform is provided with reasonable care and skill, but we do not guarantee uninterrupted availability, a minimum number of members, referrals, earnings, views or any particular result.

Nothing in these Creator Terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded. Subject to that, the Platform operator is not responsible for losses caused solely by your breach, your independent content or opinions, third-party platforms, or events outside reasonable control, nor for indirect or consequential business losses to the extent permitted by law.

14. Changes to These Terms

We may update these Creator Terms for product, commercial, legal, regulatory, safety or security reasons. We will provide reasonable notice of material changes where practicable. Continued use of creator tools after the effective date means you accept the revised terms; if you do not accept them, you must stop using the creator tools.

15. Governing Law and Contact

These Creator Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply where you live.
